Article 1: Purpose of the contract The purpose of these general rental conditions is to determine the terms of rental of the different types of scooters and bicycles (hereinafter referred to as bicycles the different models available for rental: Electric Assisted Bikes, Muscular Bikes, scooters (Kisbee 50cc and Honda 125cc) and any accessories (hereinafter referred to as the “Accessories”) through a rental contract concluded between Rent Bike Luberon and Luberon Bike Shop (hereinafter referred to as “RBL&LBS” or the "Renter") and the customer (hereinafter referred to as the "Renter") Article 2: The Renter In order to benefit from the rental contract, the signatory must be of legal age and declare themselves capable of cycling or driving. of a scooter and have no medical contraindications. Persons other than the Renter may be authorized to use the Bicycles or scooters and Accessories provided that their identity is precisely indicated in the rental contract, and that they they meet the same conditions as the Tenant, including in the case of minor children, and whose legal guardian is the signatory of the contract. Apart from the Renter and any approved users, no one is authorized to use the Bicycles or Scooters and the Accessories. Article 3: Rental terms: reservation, payment, prices, duration, deposit, availability, support a: Reservations The Renter can make reservations via the website www.rentbikescooterluberon.com or www.luberonbikeshop.com, at the point of Rental, by email or by phone. The reservation is only effective after confirmation from the Lessor by email and payment by the Lessee of a minimum deposit of 30% of the rental amount. If the Lessor were to refuse the reservation, any financial transaction would be canceled and the Renter's bank account would not be debited. The lessor undertakes to respond to emails within 5 working days. In the event of cancellation: 14 days before the start of the rental RBL&LBS reserves the right to keep the 30% deposit received during the reservation as compensation 4 days before the start of the rental, RBL&LBS reserves the right to claim cancellation fees in the amount of 100% of the total amount of the reservation. Cancellation fees will not be paid when the cancellation is caused by the duly justified illness of the Renter, or in the event of proven detestable weather conditions (mistral with gusts of more than 80km/h, rain or snow storm). RBL&LBS will not reimburse the rental but undertakes to offer you other rental dates depending on the availability of the equipment and the reservations already in place. b: Rental/payment terms/Payment methods: The Renter goes to a previously identified rental point and signs a rental contract in which he acknowledges having read the general rental conditions and accepts them. When signing the contract, the Tenant provides the necessary supporting documents (valid identity card or passport) and provides a deposit (see below). Payment for the rental (hereinafter the “Rental”) is made at the time of collection of the Bikes and Accessories, by credit card, checks, ANCV Checks (for a minimum of €60) or cash. In the same way, any other sums possibly due for the rental (deductibles, any rental extensions not subscribed to at the start of the rental period, repairs, etc.) will be payable upon return also by bank card, checks, ANCV checks or cash. At the time of delivery of the Bicycles and Accessories, an inventory will be carried out and signed jointly between RBL&LBS and the Renter. c: Prices: RBL&LBS provides the Tenant with one or more bicycles and/or scooters as well as their accessories under the pricing conditions in force on the day the rental contract is signed. These prices are described on the website www.rentbikescooterluberon.com or www.luberonbikeshop.com or at a dedicated rental point and according to defined time slots. Rental rates are subject to change before each season. Concerning the tourist circuits offered by RBL&LBS: In general, the prices do not include (unless otherwise specified in the detailed technical sheet of your circuit): Personal expenses Drinks Meals or snacks Any service not mentioned in the technical sheet of the circuit d: Duration rental/return: The Renter must return the Bike(s) or Scooters and the Accessories to the previously agreed point of departure or recovery, on the dates and times indicated. If the Tenant wishes to extend the duration of the rental and modify this date, he must inform RBL&LBS and obtain its prior agreement. No refund will be made if the Renter returns the Bike(s) or Scooter(s) and the Accessories before the scheduled rental end date. Any late return will result in the application of a fixed penalty equal to the rate of one day's rental per half-day or day of delay. The equipment must be returned in working order and in a reasonable state of cleanliness. RBL&LBS reserves the right to apply the scale of repairs and maintenance in the appendix. e: Guarantee / Guarantee deposit As a guarantee of the proper execution of his obligations by the Renter, the latter must pay a guarantee or Guarantee deposit to RBL&LBS in the amount of 600 euros per Bike or Scooter by bank card and leave a piece identity during the rental period. Photocopies will not be accepted – the name of the credit card and the identity document must match. This deposit is not collected during the rental period. Upon return of the Rented Goods, the deposit is returned to the tenant after deduction of any damage provided for in article 7. By express agreement, the security deposit is allocated to RBL&LBS in full ownership up to the sums owed by the Tenant to RBL&LBS in the case where the Tenant does not pay any sum due to RBL&LBS when due. The Tenant authorizes the Lessor to deduct from the deposit the sums due: as compensation for damage and theft, the costs of which are set out in the appendix: "nomenclature of damaged parts" as compensation for late return of the Rented Goods. is expressly agreed that the amount of the deposit cannot in any case constitute a limit of guarantee, the lessor retaining, if necessary, the right to pursue the tenant in order to obtain full compensation for his damage. f. The guide reserves the right to cancel the visit, or modify the route if safety requires it or at the request of the participants. The price of the tours includes only the guided service and the chosen bike. Personal expenses as well as meals and snacks are not included. Article 4: Condition of VAEs and Accessories, maintenance and repair The tenant acknowledges having received the Rented Goods in good working order with the basic equipment which includes the bicycle or scooter, helmet, anti-theft device and repair kit . It is also equipped with a key and a charger if the electric bike rental is longer than three days. He declares that he personally had complete freedom to verify the Rented Goods and choose them in accordance with his needs. The tenant undertakes to return the Rented Goods in the condition in which he rented them, except for normal wear and tear. The tires are in good condition and without cuts. In the event of deterioration of one of them for a cause other than normal wear and tear, the Renter undertakes to replace it with a new tire of the same brand, same characteristics and same dimensions. Any damage or reservation to the provision or return of the Bike(s) or scooter(s) and Accessories must be mentioned in the rental contract. Routine maintenance of the Bike(s) or scooter(s) as planned according to the manufacturer's maintenance requirements is carried out by RBL&LBS. Repairs, exchanges of parts or tires resulting from normal wear are the responsibility of charge of RBL&LBS and will be carried out by it. Repairs, exchanges of parts or supplies and/or accessories resulting from negligence or fault of the Renter or any approved users always remain the responsibility of the Renter according to the pricing set out in the appendix. In the event of immobilization, the Bike(s) and Accessories will then be returned to the dedicated Rental point, by the Renter and at his expense which will include removal and transport costs. In this case, the Rental continues to run normally and all subsequent obligations of the Tenant remain in force. Article 5: Conditions of use of the Bike(s) or Scooter(s) and Accessories From the time the Bike(s) or scooter(s) and Accessories are made available, the Renter has custody of them and is responsible for them. sole responsibility as well as the consequences that may result from its/their use. The Renter undertakes to respect the following instructions: The transport of a person on the luggage rack is strictly prohibited. Children (maximum weight of 22 kg) must be transported on a child seat (if the Renter opts for). Baskets (if the Renter opts for) are reserved for the transport of non-bulky objects, up to 2 kg; The Renter undertakes not to modify or add anything to the Bikes or Scooters and the Accessories. The Renter acknowledges having taken note of the fact that RBL&LBS provides helmets for each rented bicycle or scooter and very strongly advises adults to wear helmets, for safety reasons. Concerning minors under the age of 12, wearing a helmet has been compulsory since March 22, 2017. RBL&LBS cannot be held responsible in the event of the customer's refusal to wear a helmet. The Bicycle(s) or scooter(s) and its Accessories must not be used in an abnormal manner, in particular: off roadways (excluding mountain bikes and electric mountain bikes); for the transport of passengers onerous title; for subletting; for towing or pulling any object, apart from those rented by RBL&LBS; for the transport of a passenger, except transport of a young child provided that a seat child or approved trailer/carriage is installed by RBL&LBS. for the transport of flammable, explosive, corrosive, oxidizing, radioactive materials or sources of ionizing radiation. If the Renter wishes to transport the Bicycle or scooter and its accessories by his own means, RBL&LBS declines all responsibility for the operation and safety of the bicycle or scooter after loading. Article 6 - Conditions of Use, custody and return of Accessories Installation and removal of Accessories are carried out by RBL&LBS upon taking possession and returning them. From the moment the Accessories are made available, the Renter has custody of the Accessories and is solely responsible for them and the consequences that may result from their use. The Renter undertakes to take all measures to avoid deterioration, theft or fraudulent removal of the Accessories. He is responsible in the event of theft, damage or loss of Accessories. The Renter uses the Accessories in compliance with the regulations, as a good father and taking all the precautions that LBS&RBL is entitled to expect. The Accessories must be returned in the same condition as when they were made available. Failing this, any repair costs will be borne by the Tenant. The rental is granted for the fixed period appearing on the rental contract. No refund will be made if the Renter returns the accessory(s) before the scheduled rental end date. The rental company undertakes to make available all legal articles mentioned in the highway code. The user undertakes to respect the highway code as well as the necessary equipment. Article 7: Liability – Damage to rented property – Theft Bicycle rental: The Renter is responsible for damage he causes when using the Bicycle(s) or scooter(s) and Accessories. The Lessor's liability cannot be called into question for damage suffered or caused by the Bike(s) and the Accessories, unless it is proven that this damage is due to an internal defect or a fault of maintenance of the Bike(s) or scooter(s) and Accessories. The tenant declares to be the holder of personal civil liability insurance which guarantees the liability incurred during the use of the rented Goods both by himself, the people in his care and his employees. The tenant therefore does not benefit from any coverage for damage suffered by the rented item and is personally liable for said damage, breakage, loss and theft. Loss of electric bike keys: €50 Scooter rental: At the time of departure, the Renter must present the original of his motorcycle license, an international license for foreign nationals (certificates of loss or theft as well as driving licenses not translated are not accepted) and, an identity document (national identity card for French nationals, passport for foreigners) as well as proof of address less than 3 months old clearly mentioning the name of the tenant. In these cases, the tenant will bear the cost fixed at a flat rate of 150 Euros including tax per intervention. This assistance is possible during RBL&LBS opening hours, or outside opening hours but with an additional cost set at 50 Euros including tax and depending on RBL&LBS availability. It is geographically limited to roads accessible to motor vehicles and within a radius of 30 km around the nearest agency. Failing this, the tenant will make his best efforts to reach an accessible route. Article 11: Authorization to publish photographs During the rental, photographs of the Tenants may be taken. The Renter is informed and accepts that photographs in which he appears may be published by RBL&LBS on its website and on social networks such as Facebook, Instagram, Twitter, Tripadvisor, GetYourGuide, Bokùn, etc., for promotional purposes . This contract is subject to French law. Articles 13: Definitions Accident: Any sudden, unforeseen event external to the damaged property and constituting the cause of the damage. Accidental material damage: Any deterioration or destruction of the Bicycle(s) and Accessories following an accident or fall with or without an identified third party. Theft: Any sudden and unforeseen event resulting in the total disappearance of the Bike(s) or scooter(s) and Accessories mentioned on the rental contract Break-in: Force or destruction of the referenced anti-theft device linking the cycle to a fixed point of attachment on the public highway. Referenced lock: For all cycles a U-type lock, a chain-type lock, an articulated-type lock, a cable-type lock of at least 10 mm in diameter. Obsolete: A discount is applied to the value of new equipment, after deducting the VAT in force at the time of acquisition, the discount is set at 20% per year.
